acceptable use policy

Pro Host Central's Acceptable Use Policy, or AUP, is provided to give our customers and visitors a clear understanding of what Pro Host Central expects of them while using our services as well as to what is and is not allowed on our servers. Those that use our services must comply with this AUP.

The following issues are a violation of Pro Host Central's Acceptable Use Policy and will be grounds for instant account suspension or termination. Accounts that have been suspended or terminated are not eligible for a refund. Furthermore, Pro Host Central will not be held responsible for any loss of money, traffic or variables as a result of a violation of this Acceptable Use Policy.

1. Adult Content: Pro Host Central does not allow the presence of adult content on its servers.
   
   Additionally, according to the Child Protection Act, child pornography includes photographs, films, videos or any other type of visual presentation that shows a person who is, or depicted, as being under the age of eighteen and is engaged in or is depicted as engaged in explicit sexual activity, or the dominant characteristic of which is the depiction, for a sexual purpose, of a sexual organ or the anal region of a person under the age of eighteen years or any written material or visual representation that advocates or counsels sexual activity with a person under the age of eighteen years.
   
   
2. Bulk E-mail / Spam: The use of Pro Host Central's services to transmit any solicited, or unsolicited e-mail, Internet Relay Chat (IRC) or other forms of SPAM is strictly prohibited. Those who violate this policy will result in having their accounts terminated without any refunds. Accounts which have been terminated as a result of such spam are subject to a $50.00 to $500.00 fee and will result in notification to the proper authorities.
   
   
3. Copyright Infringement: Transmission, distribution, or storage of any information, data or material in violation of the United States or state regulation or law, or by the common law, is prohibited. This includes, but is not limited to, material protected by copyright, trademark, trade secret, or other intellectual property rights. Creative, utilizing, or distributing unauthorized copies of software are a violation of federal and state law. If you copy, distribute or install software in ways that the license does not allow, you are violating federal copyright laws. Pro Host Central will cooperate fully with the law enforcement agencies in relation to alleged copyright infringement housed on our servers.
   
   
4. Denial of Service (DoS) Attacks: Use of Pro Host Central's services and/or resources in any attempt to damage, degrade, disrupt, interfere, or interrupt another network, or parties ability to use Pro Host Central's services, or the Internet is strictly forbidden. All customers may not, through inaction or action, allow their services to be used by their users, or third parties for inappropriate or illegal actions. Unauthorized entry as the result of neglect will become the responsibility of the account holder and they will be held all responsibility for actions, fines, penalties and potential termination of service which may result from such unauthorized entry.
   
   
5. Distribution of Harmful Programs: Use of Pro Host Central's services or resources to intentionally or knowingly distribute software which may cause annoyance, damage, or harassment to data, computer systems, or third parties, including but not limited to the distribution of Trojans, Viruses, 'Droppers', etc. is strictly prohibited.
   
   
6. Fraudulent Activity: Any usage of Pro Host Central's services to make fraudulent offers to buy or sell items, services or any type of 'scam' such as, but not limited to, 'chain letters', 'pyramid schemes', etc. is strictly prohibited.
   
   
7. Illegal Activities: Pro Host Central's services may not be used for any illegal activities or purposes, or in any form support illegal activities or purposes.
   
   
8. Internet Relay Chat (IRC): Use of Pro Host Central's services or resources to establish any connection to IRC networks, or to host Internet Relay Chat Daemons (IRCD) is strictly prohibited. This includes the use of 'Eggdrop Bots' and 'Energy Mech Bots (EMech)'.
   
   
9. Offensive Content/Materials: Use of Pro Host Central's services or resources to create, discuss, display, distribute, post, or upload materials in which Pro Host Central deems to be offensive is strictly prohibited.
   
   
10. Policy Changes: Pro Host Central has the right to change any of the terms set forth in our Terms of Service and Acceptable Use Policy at any time without any prior notification to our clients, non-clients or general public. It is out client's responsibility to stay up-to-date with the Terms of Service and Acceptable Use Policy. At all times, customers are required to follow by these terms set forth.
    
    
11. Server Resources: Any web site that uses a high amount of server resources (such as, but not limited to, CPU time, memory usage, and network resources) will be given the option to reduce the resources used to an acceptable level, or upgrade its service to a semi-dedicated/dedicated server plan. We understand that some sites will be more resource-intensive than others. As such, all clients are permitted to use a maximum of 20% of CPU/RAM for no longer than 1 (one) minute at a time. Users constantly abusing our resources will be suspended and/or terminated. A site that is that resource intensive may be better off to upgrade to a dedicated server.
    
    Any web hosting account deemed to be adversely affecting server performance or network integrity will be shut down without prior notice.
    
    
12. Third Party Accountability: All Pro Host Central customers will be held solely responsible and accountable for any and all activities performed by third parties in which have been found using a member's account.
    
    
13. Unacceptable Use of Software: Use of software with the intent of facilitating a continual connection from, or to Pro Host Central's servers, is prohibited. This includes the intent to occupy the servers resources.
    
    
14. Unauthorized Access: Use of Pro Host Central's services or resources in any attempt to access, infiltrate, or probe another member's account, or account information, is strictly prohibited. Use of Pro Host Central's services or resources in any attempt to circumvent, or probe, Pro Host Central's electronic communications system, hardware, security measures, or software is strictly prohibited.
